City Council approves comprehensive zoning code rewrite

Powell City Council has approved a comprehensive rewrite of the City's Planning and Zoning Code, marking the completion of an 18-month effort to modernize development regulations, improve usability and streamline the development review process.

The zoning code update was identified as a community objective in the City's 2016 Comprehensive Plan and supports City Council's goal of modernizing city operations to make services more efficient and user-friendly. The updated code reflects current best practices, incorporates changes in state law, aligns with community standards and includes clearer language, graphics and diagrams to make requirements easier to understand.

"This update creates a more modern, organized and user-friendly zoning code for residents, businesses and developers while preserving the character of our community," said Planning Director Logan Stang. "It provides greater clarity and consistency for everyone navigating the planning and development process."

The project began with a comprehensive zoning code assessment completed in late 2024, followed by extensive collaboration with the Planning and Zoning Commission, City Council, staff and the community. Throughout the process, the City hosted seven Planning and Zoning work sessions, a joint City Council and Planning and Zoning work session, multiple public surveys and discussions with the Development Committee to gather feedback on proposed updates before the draft code was finalized.

The new Planning and Zoning Code is organized into four titles and 17 chapters covering zoning regulations, subdivision and land development standards, administrative procedures and a comprehensive glossary. The revised format consolidates definitions, simplifies review procedures and establishes consistent standards for development throughout the city.

Among the updates are modernized zoning districts, revised development standards for landscaping, parking and signage, improved subdivision procedures, clearer approval processes and enhanced construction standards. The code also includes graphics and illustrations to help applicants better understand development requirements.

The adoption of the new code will not affect existing homes, businesses or properties. Existing uses, buildings and lots that do not conform to the new regulations may continue to exist under established nonconforming provisions. City staff will also monitor implementation and recommend future refinements as needed based on real-world application.

The zoning code is expected to take effect on Friday, Sept. 4. At that time, the City also plans to launch a new online permitting software system for Planning, Building and Engineering applications. An updated set of Downtown Design Guidelines will also be presented to City Council for consideration prior to the code's effective date.
